PropertyTCO™ Terms of Use
These Terms of Use govern access to and use of PropertyTCO™ Residential, including its reports, verification workflows, contractor workflows, subscriptions, and related website or mobile services. By creating an account, accessing the service, or using PropertyTCO™, you agree to these terms.
1. Platform purpose
PropertyTCO™ is designed to help users organize property information, track assets and maintenance, coordinate contractor workflows, request PropertyTCO™ Verified Report workflows, and understand the total cost of ownership of residential properties. The service is an information, documentation, and workflow platform. It is not a law firm, appraisal company, engineering firm, lender, insurance carrier, tax adviser, home warranty provider, or general contractor.
2. Eligibility and accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs through your account. You agree to provide accurate information to the best of your knowledge and to keep account contact details current. PropertyTCO™ may suspend, restrict, or terminate access if misuse, fraud, abuse, platform security risk, or legal concerns are identified.
3. Property data and user-submitted content
Users may submit property facts, asset data, photos, receipts, warranties, maintenance logs, contractor details, notes, support messages, and other materials. You represent that you have the right to submit the information you provide and that it does not violate applicable law or the rights of another party. You retain your ownership rights in your submitted content, but you grant PropertyTCO™ the rights needed to host, store, process, display, transmit, analyze, secure, and otherwise use the content to operate and improve the service.
4. Reports and verification workflows
PropertyTCO™ reports depend on the information available at the time the report is generated. PropertyTCO™ Owner Reports rely substantially on owner-entered information and platform assumptions. PropertyTCO™ Verified Reports include documented review by PropertyTCO™ of selected records and observable items within the review scope, but no report is a guarantee of future value, cost, condition, legal compliance, performance, insurability, or suitability for a transaction. Reports are informational planning and property-record tools and should not be treated as a substitute for independent legal, financial, tax, lending, insurance, engineering, construction, appraisal, code-compliance, or inspection advice.
5. Contractor marketplace and service coordination
PropertyTCO™ may support contractor requests, proposal routing, scheduling, photo documentation, ratings, and payment-state tracking. PropertyTCO™ is not the contractor performing the work and does not guarantee that any contractor is suitable, licensed, insured, available, or compliant in every jurisdiction. Contractors and requesters remain responsible for their own statements, scheduling, invoices, workmanship, taxes, compliance, and business practices. Nothing in the platform creates an employment, partnership, joint venture, or agency relationship between PropertyTCO™ and a contractor or requester.
6. Pricing, subscriptions, payment holds, and cancellations
Certain features, roles, subscriptions, reports, verification workflows, or services require payment or an active subscription. Pricing may change at any time before a new purchase is completed. When a user requests a paid PropertyTCO™ Verified Report or full-property-setup service, the user may be shown a quoted or estimated amount and asked to acknowledge that price before the request is created. Requests cancelled before work begins may be voided according to the applicable workflow. Where app store billing applies, billing, renewal, cancellation, and refund handling may also be governed by Apple, Google, or another authorized billing platform.
7. Product improvement and de-identified data
PropertyTCO™ may use aggregated, statistical, or de-identified data derived from user and property activity to improve replacement-cost defaults, maintenance assumptions, utility estimates, pricing models, forecasting quality, coverage audits, operational insights, and product design. PropertyTCO™'s goal in doing so is not to identify a specific person personally, and direct identifiers such as your name or email are not intended to be part of those model-improvement datasets.
8. Acceptable use
You agree not to misuse the platform, interfere with the service, attempt unauthorized access, scrape or reverse engineer the service beyond what applicable law permits, submit fraudulent or infringing materials, or use PropertyTCO™ in a way that violates law or the rights of another person or business.
9. Third-party services
PropertyTCO™ may rely on third-party infrastructure and service providers, including cloud hosting, authentication, notifications, storage, mapping, and future billing or payment tools. Availability of PropertyTCO™ may depend in part on these third-party providers.
10. Disclaimers
To the fullest extent permitted by applicable law, PropertyTCO™ is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy. PropertyTCO™ does not warrant that the service will be uninterrupted, error-free, secure, or suitable for every property, transaction, or professional use case.
11. Limitation of liability
To the fullest extent permitted by law, PropertyTCO™ and its owners, operators, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, business interruption, property decisions, transaction outcomes, contractor conduct, or similar losses arising out of or related to your use of the service.
12. Indemnity
You agree to defend, indemnify, and hold harmless PropertyTCO™ and its affiliates, officers, owners, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from your submitted content, your use of the service, your violation of these terms, or your violation of law or another party’s rights.
13. Changes to the service and these terms
PropertyTCO™ may update the platform, workflows, pricing, or these terms from time to time. Updates become effective when posted unless otherwise stated. Continued use of the service after an update means you accept the revised terms, to the extent permitted by law.
